Rental Policy

Advance Reservations
Reservations can be made up to one (1) year in advance, however, rates and properties are not guaranteed. Rates and properties are subject to change without notice. A minimum payment of fifty (50%) percent down per reservation is required at the time of booking the reservation. The advance payment is not a damage deposit. If you are paying by check, we will need to receive the payment within 5 days of reservation

Age Requirement  
Our customary policy is no reservations will be made to students or singles under the age of twenty-five. Parents must accompany their children under the age of twenty-five at all times. This policy includes reservations made by parents who do not check-in, and/or who leave overnight during the length of the stay. NO EXCEPTIONS! We require one parent for every four persons under the age of 25. Non-compliance with these rules and regulations will result in immediate eviction with no return of any and all funds paid. In accordance with Florida State Statute 509.141, reservations made under false pretense are null and void and check-in will not be allowed. No underage drinking and/or partying is allowed. Our rental properties are monitored for violations of this policy.

Assignment
FVR may assign this Agreement or any of its rights, or delegate any of its duties under this Agreement, at any time without your consent.

Beach Rules
Please make every effort to keep our beaches beautiful and our gulf clean from debris. Remove all tents, chairs, toys, and other misc. items from the beach each day. For your safety, please observe the warning flags posted at every public access.

Beach Service
Beach service availability is seasonal only, per property. Please contact a reservationist to determine beach service availability and dates.

Cancellation
We do not offer a cancellation policy. Once payment is received, we will not issue a refund, for any reason. We highly suggest you purchase your own vacation rental insurance with a carrier of your choice.

Check-In, Check-Out Time
Check-In is 4:00 P.M. (CST) or later. During peak season, your vacation property might not be ready by 4 P.M. Check-Out time is promptly at 10:00 A.M. We DO NOT allow early check-ins or late departures. Guest will be billed ½ days rental for late check-outs.

Construction
We cannot predict construction plans in the area and therefore cannot be held responsible for any inconvenience. No refunds can be given in the event of nearby construction.

Key Policy
Any Keys/Fobs/Wristbands/Access Cards/Garage door openers etc., for the rental, must be returned to Forever Vacation Rentals at check-out. Failure to return these items will result in additional fees.

Late Arrivals
If you are staying at Silver Beach Towers, please contact us if you plan to arrive after 5 pm CST on the date of your arrival.  The lobby doors lock early and you will need to get a FOB key for another secure location (about 5 mins away) to gain access into the building.

Personal Property (Lost and Found):
Forever Vacation Rentals is not responsible for any theft, vandalism, or damages to any personal property or personal items of guests staying at our rental property.   There is no guarantee that Forever Vacation Rentals will be able to find any personal property left by a guest upon departure from the rental property.   Forever Vacation Rentals is not responsible for and is not obligated to find or store a guest’s personal property.   Forever Vacation Rentals may dispose of such property without notice, consent, delay, or liability.   Guests will be responsible for all shipping charges and applicable time.

Furnishings
These properties are privately owned. You may not agree with the placement of items, furnishings, and/or mattress comfort level; however, this is the arrangement preferred by the owner. We encourage you to call us if you have any comments or concerns. No refunds or rate adjustments will be given due to owners’ choices on furnishings.  For your convenience, a property floorplan tour is available on every property.

Good Neighbor Policy
Because the Property is a privately owned home, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Forever Vacation Rentals from police, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations.

Holiday Reservations
Please keep in mind that the kitchens are stocked with basic supplies. With that said, when cooking your holiday meals if you require a special pan, utensil, cooking pot, turkey baster, pie plates, several mixing bowls, etc. please do not forget to pack it.  Deep frying of turkeys is not allowed at any of our properties.  Our office is closed on Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the day after Thanksgiving, Christmas Day, and New Years Day.  During this time, we will not be readily available for phone calls, texts, or emails unless there is an EMERGENCY:  Fire (call 911), Water Leak, Gas Smell, Alarm Beeping, A/C not cooling (only if outside temps are 80 degrees or hotter), Heat not working (only if temps fall below 50 degrees), Person stuck in an elevator.

Not considered an emergency call: dripping faucets, backed up toilet (plungers can be found in the bathroom), TV’s / Wifi connection, or a routine maintenance request (Please refer to the binder in the property you are staying at). In addition, please keep in mind that WiFi service is not considered an emergency so if you are relying on service please bring a personal hot spot as a backup.

Housekeeping Fee
A housekeeping fee will be added to all reservations, regardless of the number of nights booked. The fee will vary depending on the size of the property. Laundry facilities are provided either in the rental property or on the grounds of the property.   The property will also be stocked with an initial supply of trash liners, toilet paper, bath soap, and dishwasher soap. IF, on ARRIVAL, you have ANY HOUSEKEEPING PROBLEMS, report them to the Guest Services Team IMMEDIATELY so that they may be remedied. NO DISCOUNTS WILL BE GIVEN DUE TO HOUSEKEEPING.

Hurricane
We highly suggest that you purchase a trip insurance plan of your own choosing. We will not reimburse for any acts of God or circumstances beyond our control.

Internet Access
Privacy & terms usage for properties with internet access. Users/guests may not use the internet access contained in or around Forever Vacation Rentals for malicious or unethical activity; including assessment of other people over the internet or that violate federal, provincial, or copyright laws. This act is in conjunction with the Digital Millennium Copyright Act. Any and all misuse that is reported will be dealt with swiftly. The guest that is listed on the reservation is ultimately responsible for the guest’s/family member’s actions during the duration of their stay. Most of our properties have internet access, either fee-based or free, through their individual service providers. We do not, however, guarantee internet connectivity due to service being provided by an outside vendor, restrictions from personal computers, and several other factors that may lead to interruption of internet service. In the event the internet service is inoperable, we will do our best to troubleshoot over the phone but if it requires further assistance, the guest will be responsible for contacting the internet provider. No refunds will be given due to the loss of internet service.

Maintenance Problems
During your stay, promptly report any maintenance problems to Forever Vacation Rentals. Please do not leave doors or windows open while the A/C or heaters are operating. If the A/C is frozen during your stay, you will be charged for the misuse of the system (this typically happens when guests do not close windows and doors, while leaving the A/C running). Forever Vacation Rentals’ staff may enter the property to respond to any maintenance and/or housekeeping issues during your stay. No refund or rate adjustment will be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, telephone, television or cable service, wifi, appliances, etc.  Please note that a backed-up toilet is NOT considered an emergency if you have more than one toilet.  If the toilet overflows during your stay, please call us immediately.  A backed-up toilet caused by Guests’ neglect or misuse will incur an after-hours emergency fee: $75 trip charge plus $30 per half hour (billed to guests).  If you lock yourself out of a room during your stay, you will be charged: $75 trip charge for an after-hours emergency fee (billed to guests).  If you prefer, you are welcome to call a local Plumber or a Locksmith for assistance.  Invoices for a third-party vendor will be at the guest’s expense.  Any maintenance requests deemed not an emergency will be addressed the next business day.

Maximum Guests
The maximum number of guests per accommodation is based on the individual property’s occupancy rating. For liability and safety, the listed maximum occupancy of the property may not be exceeded. Please note that County Code Enforcement Officers also monitor the occupancy rules and will report them to us. Violations may result in immediate eviction and forfeiture of payments made.

Method of Payment
When making reservations thirty (30) days or more in advance, the method of payment is by credit card (MasterCard, Visa, or Discover Card) or personal check for the reservation deposit. Accepted forms of payment are in U.S. funds only. For reservations made less than thirty (30) days prior to arrival, immediate payment in full is required by credit card (MasterCard, Visa, or Discover Card). Remember that your final payment is due thirty (30) days prior to arrival

Neighborhood Rules/HOA
Most vacation properties are controlled by a Home Owner Association. These associations have very strict rules that must be respected i.e.: limited parking, parking on sidewalks, towels hanging from balconies, garbage can retrieval, weddings, etc. Most violations warrant a fine that the guest will be responsible for paying.  We will charge your credit card on file for citations imposed by HOA’s.  If you feel the citation is not merited, please contact the person(s) named on the citation.  They are your best source to have the fine/citation reduced or waived.

Noise Ordinance
Florida Statute 125.01 prohibits excessive noise at any time. Quiet time for all properties is 10:00 P.M. until 7:00 A.M., in conjunction with county ordinances. Please be considerate of your neighbors. Radios, stereos, and all other musical or entertainment devices will be played in compliance with the decibel level. The decibel levels cannot exceed fifty (50) decibels between the hours of 10:00 P.M. and 7:00 A.M. outdoors. Music played inside may not be heard outside of the property with the doors and windows closed. At 10:00 P.M., all guests not staying at the property need to depart from the premises.

No Permanent Residence
You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.

Owner’s Closet/Owners Furnishings 
Most properties have interior locked closets (Owners Closet) that are off-limits to guests. All properties are privately owned and their furnishings vary depending on the Owners taste. We cannot guarantee the presence of a particular listed furnishing. Forever Vacation Rentals cannot be held liable for errors, omissions, changes in price, or furnishings.

Payment Terms; Fraud
If you are paying by credit card you represent that you are the account holder or an authorized user of the account. If for any reason, FVR believes your payment may be refused by the card processor, FVR may ask you for a different form of payment. Upon FVR’s request, you will immediately provide another form of payment and adequate proof that you are the account holder or an authorized user of the account used for payment (such as a government-issued ID that matches the name on the account). FVR may cancel your reservation or remove you and all Occupants from the Property immediately if you fail to provide a form of payment that can be validated by FVR. We may share your credit card information and other information about you with law enforcement if we suspect fraud.

Pet-Friendly Properties
Forever Vacation Rentals has an inventory of pet-friendly properties. While outside, pets must be on a leash at all times. A person with a pet must collect and properly dispose of all fecal matter. Any reservation made under false pretenses will be subject to forfeiture of any/all payments of rent and deposits, and the party will not be permitted to check-in. If the party has already checked in, they will be evicted and subject to additional cleaning expenses. Pets are not permitted on the beach. A non-refundable fee is required for pet stays and additional deposits may be required. Pet owners will be financially responsible for any damages and extra cleaning. The Peace of Mind Protection Plan does not cover any pet-related incidents.

Pests
While Florida is the ideal attractive vacation destination, its warm and humid climate and bodies of water can also make for an attractive environment for pests. With water surrounding all sides of our area, pests such as palmetto bugs, spiders, flies, mosquitoes and ants can be prevalent around your vacation rental home. Please note that Palmetto bugs are a type of Southern climate pest – these are not the cockroaches associated with Northern and Midwestern states. Often, humidity and rain can drive Palmetto bugs indoors. While all of our homes participate in consistent, routine pest control plans (treatment will be reapplied upon request), sightings of pests indoors is not an indication that the home has not been properly cleaned and will not warrant compensation. In order to reduce the presence of these pests, we offer the following suggestions:
• Turn off all unnecessary lights. Lights located inside the garage, around the pool, decks, home exterior, etc. are the most common attractors to flying insects.
• Make sure all windows, entry doors and sliding doors are closed
• Clear away all trash frequently and make sure no food is left out on countertop

Pool Policies
Diving or jumping into the pool or Jacuzzi may result in head, neck, or spinal injuries. As the renter, you accept the risk of the pool and specifically agree that no minor will swim in the pool unaccompanied by an adult. Pool heat is offered seasonally between October and early May, however, pools cannot be heated if the temperature is below fifty-two (52) degrees or above eighty (80) degrees. The pool temperature will be set between eighty (80) and eighty-five (85) degrees. Please contact a Forever Vacation Rentals representative for details about the additional cost. Allow forty-eight (48) hours for the pool heater to heat the pool water to the set temperature. Tampering with pool equipment may result in injury and/or a fine. All pool equipment must be operated by a licensed professional. Community or condominium pools and/or Jacuzzi’s are not controlled or maintained by Forever Vacation Rentals therefore we cannot be held responsible for inconveniences resulting from the pool.

Peace of Mind Protection Plan*
(Limited Damage Protection) TERMS OF PROTECTION: As a Guest (the person registered and all persons occupying the same rental unit) you are entitled to the Peace of Mind Protection Plan while staying at a Forever Vacation Rentals’ property. The Peace of Mind Plan is subject to the conditions, terms, and administrative procedures listed below. The maximum amount that the Plan will cover is $1,500 per stay. CONDITIONS: The Peace of Mind Protection Plan has certain conditions. The Plan will not include liability for damage or theft resulting from:
– Acts of God
– Intentional acts of a guest.
– Gross negligence or willful and wanton conduct.
– Any cause, if the Covered Guest does not report the damage to Forever Vacation Rentals’ staff.
– Normal wear and tear.

Property Damage
In order to provide our guests with the best vacation possible, we ask that all damages to the property upon arrival be reported to Forever Vacation Rentals in writing. Please document by sending to: ForeverRentals@live.com. An active credit card is required to maintain the reservation and the integrity of the unit. By signing this agreement you waive your right to dispute any charges that are made to your credit card regarding this policy. Non-billing stipulations include:
• No damage to the property or theft. • No violations of rental or association policies.• Rental is left in a neat and orderly condition. • All garbage is removed from the house (Bagged/Sealed) and pool areas and all keys and garage door openers remain in the house.  Forever Vacation Rentals will notify you of impending charges by email; however, we reserve the right to bill the credit card for violations of the policy.

Rates
Published rental rates are subject to change without notice. We reserve the right to correct rates that may have been misquoted due to human and/or computer errors.

Reservation Changes
Once a reservation is confirmed, guests may not make any reservation changes or modifications.

Responsible Renter
As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over the Minimum Age, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.

Service Animals
While we would prefer to keep many of our properties animal-free because of various homeowner allergies (and other guests possibly in the building at the time) we would be happy to host you and your Service Animal. We have strict guidelines for those who wish to bring their Service Animal.   A Service animal staying on our property is NOT allowed to be left in the home alone at any time during your stay. This means not even being left alone in a crate. You must take the animal with you anytime you leave the house. The guest remains liable for any and all damage caused by a Service Animal. You and your Service Animal will be asked to leave if we discover misrepresentation of a pet as a Service Animal. We will report fraudulent claims of Service Animals to government authorities and will evict the guest(s) without further notice in such cases. If this occurs, there will be no right to a refund. On a final note, please understand that many HOA’s and Condo Complexes do not allow animals at all.  During your stay, please make sure you bring any documentation that might be needed.

Please be prepared to answer these two questions:
1) Is the assistance animal required because of a disability?
2) What work or task has the animal been trained to perform?

Below are some rules so that both your stay and that of our guests after you will be enjoyable and relaxing:

• Your Service Animal may not be left unattended. (Crating and leaving the animal in your absence is not permitted; the animal must accompany you AT ALL TIMES).

• Please provide an advanced copy of your Service Animal rabies vaccine (current thru your stay). Please email within 48 hours of booking to:  ForeverRentals@Live.com

• Your Service Animal must be on a leash at all times or under control of verbal or sight commands that they follow at all times.

• We will ask you to remove your Service Animal if the animal is out of control and the animal’s handler does not take effective action to control it or if the animal is not housebroken.

• Please walk your Service Animal for bathroom needs. Indoor piddle pads are not allowed.

• Please clean up defecation immediately. Bring your own baggies and dispose of them immediately into the outside dumpster.

• Service Animals may not be on furniture (sofa, chairs, bed) or counters unless it is specifically needed for your disability.  If required, please report so that we can arrange additional cleaning.

Smoking
Smoking is strictly prohibited in all properties. We reserve the right to bill the credit card on file for violations of the policy.

Subletting 
The rental property may not be sublet. Your reservation is not transferable to any other party.

No Daily Maid Service/Linens/Limited Supplies
Linens and towels are provided with the rental. Please remember to bring your beach towels. Daily maid service is not provided. We offer a startup supply of two kitchen trash can liners, two dishwashing packets, mini shampoo, conditioner, lotion, one roll of toilet paper per bathroom, and one roll of paper towels.  We supply two bath towels per person, one washcloth per person, and two hand towels per bathroom.  We do not supply beach towels, laundry detergent, or liquid dishwashing detergent.

Special Events
Please contact us for weddings or special events.  Most special events will incur additional charges.

Taxes
Florida has a state sales tax that we charge to every reservation.  We manage properties in the following counties: Bay, Okaloosa, and Walton.   Each County charges an occupancy (aka bed tax).   Amounts charged are subject to change by state or local government.  Tax is added to all rentals of 180 days or less.  Guests are responsible for paying all applicable taxes in full prior to checking in. Taxes will be disbursed to the governing authority upon check-out and are subject to change without notice.

Trailers, RV’s, Motorcycles and Golf Carts
Trailers and RV’s are not permitted at most of our properties due to homeowner associations and size. Also due to noise restrictions in some neighborhoods and resorts, Motorcycles and Golf Carts may not be permitted.

** LIABILITY WAIVER ** 

A)  Owners and Managers of this property are not liable for loss, damage of property, injury to me or my guests during my stay on the premises.

B)  I hereby release, waive, discharge and covenant not to sue the owners of this property, its offices, staff, agents, or employees for any liability, claim, and or cause of action arising out of or related to any loss, damage or injury, including death that may be sustained by me or to any property belonging to me arising out of the use of the house or property.

C)  Indemnification: Guest and their party agree to indemnify and hold harmless Forever Vacation Rentals and its employees, from and against all claims, suits, damages, costs, losses, and expenses arising from injury to any person or property occurring on or about the Property.

D) Class Action and Jury Trial Waiver: The parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, the parties waive any right to a jury trial.

Acknowledgment & Disclaimer
You acknowledge the Property may have features, amenities, and conditions that are unfamiliar to you and other Occupants you invite to the Property. You further acknowledge that your use of the Property and its amenities may carry inherent risk, including risk of bodily injury, illness or disease, disability, or death. For example, some Properties include natural habitats for wildlife, insects, and pests that may expose you to injury or disease; or docks, stairways, porches, ledges, cliffs, hot tubs, and other unmarked natural or manmade features, amenities, and conditions that carry inherent risk. You agree that, by using the Property or its amenities, you voluntarily and willfully assume those risks and assume full responsibility for the choices you make before, during and after your use of the Property and its amenities. You also acknowledge and agree that you and any other adult Occupants are solely responsible for closely supervising and protecting the health and safety of any and all Occupants that are minors, throughout the duration of your stay.

CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS: 
If a catastrophe (hurricane, tornado, earthquake, flood, etc.) or any situation simply beyond our control impairs the vacation rental, Forever Vacation Rentals is not responsible for finding alternate lodging for the renter or for the renter’s financial losses related to transportation or alternate lodging. There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. Whether you own property, run a business, or rent a property in Florida, the threat of a hurricane, flood, or simply bad weather is always present during certain months of the year, and we all assume this risk. Therefore, we suggest you consider Travel Protection Insurance to secure your vacation investment and eliminate your financial risk. There will be no refunds of any kind for evacuations.

CONTRACTUAL ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19 AND FOREVER VACATION RENTALS
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and the Center for Disease Control (CDC). COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Neither Forever Vacation Rentals, the Lessor, nor the Individual Property Owners, nor Homeowners Association, Inc can guarantee that tenants, its family, or guests will not become infected with COVID-19 while using the leased property and community amenities. Tenant acknowledges that Rental Management, Lessor, Property Owner, and Association do not carry liability insurance providing coverage for contracting an infectious disease. Tenant also acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that tenant and all members of their party may be exposed to or infected by COVID-19 while using the leased property and community amenities and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

Tenant agrees to assume all of the foregoing risks and accept sole responsibility for any injury to itself, members of its party and guests (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind that we may experience or incur in connection with our use of the rented property and community amenities.

Tenant hereby releases and covenant not to sue, discharges, and agrees to defend and hold harmless Rental Management, Lessor, Property Owner and Homeowners Association, Inc of and from the claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto to the contraction of the coronavirus infection or COVID-19. Tenant understands and agrees that this release includes any claims based on the actions, omissions, or negligence of the Rental Management, Lessor, Homeowners Condominium Association, Inc, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after the lease term.

Tenant acknowledges the contractual assumption of the risk as set forth herein is a specific condition of Lessor agreeing to lease the property. The tenant acknowledges this is a specifically negotiated term and the monetary amount of the lease is specifically based upon the inclusions of this provision.
